These Terms of Service (“Terms”) govern your use of catchthewaveswim.com (the “Site”) operated by Catch the Wave Swim Club (“Catch the Wave,” “we,” “us,” “our”). By accessing or using the Site, you agree to these Terms. If you don’t agree, do not use the Site.
Catch the Wave provides information about swim lessons, programs, locations, and enrollment. The Site may also include links or tools that allow you to request enrollment, tours, or contact us.
You agree to use the Site only for lawful purposes and in a way that does not:
violate applicable laws or regulations,
infringe others’ rights,
interfere with the Site’s operation or security,
attempt unauthorized access to systems, accounts, or data,
transmit malware, spam, or abusive content.
We may suspend or block access if we believe misuse is occurring.
When you submit forms on the Site (e.g., name, email, phone, message, location selection), you agree that:
the information you provide is accurate to the best of your knowledge,
you will not submit content that is unlawful, threatening, harassing, defamatory, or otherwise inappropriate,
you understand that submitting a form does not guarantee enrollment or placement.
Program descriptions, schedules, instructors, and availability may change without notice.
Enrollment may depend on availability, age/skill fit, prerequisites, and location capacity.
Any dates/times shown on the Site or via third-party scheduling tools are subject to confirmation.
If payment is offered or required through the Site or a linked tool, the specific payment terms, fees, cancellations, and refund rules will be presented during checkout or by the location team. Those terms control where they differ from these Terms.
Swim instruction involves inherent risks. Parents/guardians are responsible for providing accurate information about a participant’s needs, supervision requirements, and any relevant conditions that may affect safe participation. Catch the Wave may require additional forms, waivers, or acknowledgements before participation.
All content on the Site—including text, graphics, logos, photos, videos, and layout—is owned by Catch the Wave or used with permission and is protected by intellectual property laws. You may view and use the Site for personal, non-commercial purposes only. You may not copy, reproduce, distribute, or create derivative works without written permission.
The Site may link to third-party services (e.g., enrollment tools, scheduling, maps, analytics). We don’t control those services and are not responsible for their content, availability, or practices. Your use of third-party services is governed by their terms and policies.
Your use of the Site is also governed by our Privacy Policy. Please review it to understand how we collect and use information.
The Site is provided on an “as is” and “as available” basis. We make no warranties that the Site will be uninterrupted, error-free, secure, or that content will always be current or complete.
To the fullest extent permitted by law, Catch the Wave will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue arising from your use of (or inability to use) the Site or any linked third-party service. Our total liability for any claim relating to the Site will not exceed the amount you paid us through the Site in the 12 months before the event giving rise to the claim (or $100 if you paid nothing).
You agree to indemnify and hold Catch the Wave harmless from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your violation of these Terms, or your violation of any law or third-party rights.
We may update the Site and these Terms at any time. The “Effective date” above reflects the latest version. Your continued use of the Site after changes means you accept the updated Terms.
These Terms are governed by the laws of the State of Illinois, without regard to conflict of laws rules, except where prohibited by law.

To reinforce BraveSwim™ survival skills, we offer optional, age-appropriate Water Safety Challenges at no additional cost:
During these challenges, swimmers practice applying their survival skills fully clothed — entering the water and demonstrating age-appropriate safety responses in more realistic conditions.
